ICSID annulment explained
- Legal basis
- Article 52 of the ICSID Convention 1
- Deadline
- 120 days after the award. For corruption, 120 days after discovery and no later than three years after the award 1
- Who decides
- An ad hoc committee of three persons appointed by the Chairman of the Administrative Council from the Panel of Arbitrators 1
- Outcomes to 30 June 2026
- 124 applications rejected, 28 awards annulled (20 in part, 8 in full), 51 proceedings discontinued 3
- Stays of enforcement to 31 December 2023
- 136 requests, 64 granted, 35 of those conditioned on security or an undertaking 4
The five grounds
Article 52(1) lists the only grounds on which either party may request annulment 1.
Who sits on the committee
On receipt of a request, the Chairman appoints three persons from the Panel of Arbitrators. None may have sat on the tribunal that made the award, share the nationality of any tribunal member, be a national of either state involved, have been designated to the Panel by either of those states, or have acted as conciliator in the same dispute 1. The committee may annul the award or any part of it on the listed grounds 1.
Annulment is not an appeal
ICSID's March 2024 background paper quotes the 1963 preliminary draft of the Convention, which said annulment "is not a procedure by way of appeal requiring consideration of the merits of the case" 4. During drafting, Aron Broches said a mistake in the application of the law would not be a valid ground for annulment. He confirmed that failing to apply the law the parties agreed could amount to an excess of power 4.
The paper records that proposals to delete the word "manifestly" were defeated 23 to 11, and a proposal to add "manifestly incorrect application of the law" as a ground was defeated 17 to 8 4.
Stay of enforcement
Under Article 52(5), a committee may stay enforcement pending its decision. If the applicant asks for a stay in its application, enforcement is stayed provisionally until the committee rules on that request 1.
ICSID reports that several committees have held there is "no presumption in favor of a stay of enforcement" and that one factor considered is the risk of non-recovery if the award is annulled 4. Of 136 stay requests to 31 December 2023, 64 were granted. Of those, 35 were conditioned on security or a written undertaking, and 15 of those stays were terminated when the condition was not met 4.
What happens after annulment
If an award is annulled, either party may resubmit the dispute to a new tribunal under Article 52(6) 1. The committee does not rule on the merits itself 4. ICSID records that annulment proceedings were brought a second time after resubmission in 5 cases 4.
The numbers
ICSID's caseload statistics to 30 June 2026 give these cumulative counts 3.
Common questions
Can an annulment committee change the amount of an award?
No. It can annul the award or part of it 1. It does not rule on the merits, which go to a new tribunal if a party resubmits 4.
Is enforcement stopped during annulment?
Only if a stay applies. A stay requested in the application applies provisionally until the committee rules 1. Committees often attach conditions such as security 4.
Who files most annulment applications?
To 31 December 2023, respondents filed 57% of applications, claimants 38% and both parties 5%, according to ICSID 2.
How long does a party have to apply?
120 days after the award. For corruption of a tribunal member, 120 days after discovery and within three years of the award 1.
